The Indiana Petroleum Marketers and Convenience Association (IPCA) recently provided comments in response to the Indiana Department of Environmental Management's proposed rulemaking concerning the Underground Storage Tank Excess Liability Trust Fund (ELTF). The comments were offered by Plews Shadley Racher & Braun LLP attorneys Chris Braun, who has served as General Counsel to the IPCA for 16 years, and Angela Dorrell. The IPCA is a nonprofit association that represents more than 200 companies engaged in the wholesaling and retailing of refined petroleum products. The IPCA's members are concerned that IDEM is seeking to restrict access to the ELTF and narrow eligibility for reimbursement. Funding mechanisms for environmental investigation and remediation costs related to petroleum releases from USTs are of critical importance to the IPCA's members.
