April 11, 2013   Marion Circuit Court Awards Summary Judgment in PSRB Meth Case

Marion Circuit Court Judge Lou Rosenberg has awarded a summary judgment order with regard to insurance coverage for damages caused by methamphetamines.   The case was brought by Plews Shadley Racher & Braun LLP Partners George Plews and Tonya Bond on behalf of clients Larry and Gloria Sturgeon.  

The Sturgeons sought damages on claims filed on a property insurance policy with Remington Farmers Mutual Reinsurance Company and a liability insurance policy with Grinnell Mutual Reinsurance.   The couple had rental property in West Point in Tippecanoe County.   In 2011, The Indiana State Police found that the tenants of the Sturgeons’ property were operating a methamphetamine lab that had contaminated the home.   The Tippecanoe County Health Department then declared the property uninhabitable until it could be cleaned and decontaminated.  

The Sturgeons notified their insurers, but both insurers denied the claim based on exclusions.  However, the parties cross moved for summary judgment and the court     ruled in the Sturgeons’ favor and against both insurers.
