An Indianapolis environmental court recently affirmed the Office of Environmental Adjudication (OEA) and held that a petroluem underground storage tank owner was in substantial compliance with environmental laws and therefore entitled to receive reimbursement from Indiana’s excess liability trust fund (ELTF). The case provides several important holdings to overcome IDEM’s improper denial of ELTF claims. The ruling has been published by Westlaw.
