Lake and Porter Counties Attain 8-Hour Ozone NAAQS

The EPA has determined that Lake and Porter Counties have attained the 1997 8-hour National Ambient Air Quality Standard (NAAQS) for ozone and proposes to redesignate these counties – which form the Indiana portion of the Chicago-Gary-Lake County, Illinois-Indiana ozone nonattainment area – from nonattainment to attainment. In conjunction with the March 12, 2010 rulemakings, the EPA approved a temporary waiver for these two counties from the Clean Air Act provisions requiring emission sources to apply Reasonably Available Control Technology (RACT) to reduce emissions of nitrogen oxides (NOx). The waiver will become permanent if the proposed redesignation of Lake and Porter Counties becomes final.
